Help!

My main Co$ debunking channel, xenuphilia has been suspended by YouTube due to false DMCAs put forth by Axiom 10 Productions.

My videos consist of clips of other videos and my responses -- very similar to the videos Onision DMCA'd in this video:


In Section 10.1 of the YouTube Terms of Service, it states that:
10.1 When you upload or post a User Submission to YouTube, you grant [...] to each user of the Website, a worldwide, non-exclusive, royalty-free, licence to access your User Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions to the extent permitted by the functionality of the Website and under these Terms.

and I have to say I'm a bit saddened.

Eventually, in the course of this video, after applauding what people have done in part by reading that "derivative works" clause as a license to consider all YouTube videos as a sort of public domain resource for response, remix and dialogue of a newish kind, he makes the point that technically much of what people are doing, and most of what he finds of interest on YouTube as an academic anthropologist, is illegal or borderline so, mainly as violations of copyright. I suppose the death knell for what YouTube once was, and is clearly trying to distance itself from at present, as a business and an organization, will come when this video is DMCA'd into oblivion.

I get the impression that YouTube now wants to read that clause very narrowly... that the derivative works they are speaking of are meant to be limited to all the various encodings for different devices that are, technically, and strictly speaking, derivative works from the channel owner's original upload.

After all, if one reads that clause more openly, claiming that one grants every user derivative work rights to everything posted, then why would networks and "big league" production companies be the least bit willing to post full episodes of their costly-to-produce content on YouTube, thereby granting everyone with the skills to make derivative works from "their" full-length movies or TV programs?

Please note, none of this is making any explicit judgment on how that clause should be interpreted. I'm not a lawyer, and even if I were I certainly would not claim that my own inferences and interpretations of YouTube's views (deduced entirely from their actions rather than any statements they may have made) are in any way accurate assessments of the legal issues at hand, especially since few of them have been tested or tried in actual courts.

An associate of mine is in the process of going after "axiom10 Productions" in a legal venue. I'm not sure where they are with it at this juncture, but they were interested in finding others that have received false DMCA's from them. I've heard that a counterclaim can be filed by-proxy. There's also another contact or two which could be useful if you wish to deal with this nuisance.

If you're interested I'd be more than happy to get in touch with my contacts regarding this issue.

Idiotic Footnote; Scientology axiom 10 is about conquering "MEST" and destroying what-ever is "contra-survival".. I guess your channel must have been contra-cult-survival *smirk*

Thanks, 13Heathens. And I don't believe I've thanked you enough for publicizing my channel on yours. :)

Feel free to mention my channel to your friends, but I'm not really planning to pursue legal action against Axiom 10.

I WILL however be posting my videos on other sites. :)
